PRIVACY POLICY

It is American States Utility Services’ (collectively with its affiliates, “Company’s” or “our”) policy to respect and protect the privacy of its clients and all users (“User” or “Users”) of https://www.asusinc.com (“Site”). We have prepared this Privacy Policy to provide Users with important information about our privacy practices. By using the Site, you are consenting to the Privacy Practices described in this Privacy Policy.

The Company collects information that Users provide directly to us. For example, the Company collects and/or requests information when a User:

• Contacts us using an online form

• Submits an e-mail for any reason

• Prints and completes any form data (whether returned online or via fax or mail)

• Submits information over the Company’s social media channels

In addition to the information you provide to us directly, we may collect information about your use of the Site. For example, we may collect:

• Device information, such as your IP address and other unique identifiers, hardware model, operating system version, browser type and settings, and the settings of the device you use to access the Site.

• Information about your use of the Site, such as the time and duration of your use of the Site, other information about your interaction with content offered through the Site, and any information stored using cookies and other Internet technologies.

The Company uses this information for its business purposes, such as responding to User requests, understanding use of and improving our Site (and other products and services), protecting, enforcing and defending legal rights, privacy, safety or property, incorporating feedback into promotional and informational materials, and communicating with Users via email, regular mail, and phone.

Sharing User Information

The Company does not disclose, share or exchange online information that Users provide to us, including email addresses, with third parties for their use for their own marketing purposes. The Company may share information:

• Among our affiliated companies that are under common control with ASUS

• With vendors providing contractual services to the Company

• With a User’s consent or at their direction

• As the Company believes is necessary or appropriate to protect, enforce or defend the legal rights, privacy, safety or property, including by responding to requests from public and government authorities

• In the event the Company sells or transfers all or a portion of its business or assets to a third party, such as in the event of a merger, acquisition, or bankruptcy reorganization

The Company also may share information in a manner that does not identify particular users.

Cookies and Other Internet Technologies

The Company, as well as third parties that measure and analyze performance on the Site and/or provide content and functionality on the Site, may use cookies, web beacons, mobile ad identifiers, and other technologies to facilitate administration and navigation on the Site, to better understand and improve the Site, and to provide Users with a more relevant online experience, both on the Site and elsewhere. This information may be combined with information collected across different websites, online services, and other linked or associated devices. These third parties may use User information to improve their own services and consistent with their own privacy policies, which may contemplate serving targeted advertisements.

• Cookies. Cookies are small files that are placed on a User’s computer when visiting a website. Users that wish to disable cookies should refer to their browser help menus to learn how to disable cookies. If a User disables cookies, it may interfere with the proper functioning of the Site.

• Other Internet Technologies. There are other Internet technologies, like web beacons (also called “tags” and “pixels”) that allow a server to read certain types of information from a User’s device and like Local Shared Objects (also referred to as “Flash cookies”) and HTML5 local storage that can be used to store certain information about your activities and preferences on your device or to otherwise track such Information. These technologies may make use of different parts of your device from standard cookies, and so you might not be able to control them using standard browser tools and settings. For HTML5 local storage, the method for disabling will vary depending on your browser. Additional Choices. In addition to the disabling cookies and other tracking technologies described above, some of the third parties that use cookies, web beacons, and other Internet technologies to collect information from the Site may participate in industry-developed programs designed to provide consumers with choices about whether to receive targeted advertisements. to learn more and to opt out of such targeted advertising from participating companies, please visit the websites of the Network Advertising Initiative and the Digital Advertising Alliance.

Some third parties may offer their own choices. For instance, Google Analytics offers users certain additional choices that Users can learn more about by clicking here.

External Websites

The Site contains links to external Internet websites, or those websites that are operated by an external party. When Users click on links to such external websites, Users will be subject to the privacy policies of those external websites. The Company strongly encourages all Users to become familiar with the privacy policies of any external websites visited from, and/or linked to, the Site as the Company is NOT responsible for the content contained within any external website, nor the credibility of the organization named, related to, or hosting the external website, nor for the credibility, veracity or legality of any information contained within the external website.

Please note that this Privacy Policy applies solely to information collected by the Company on its Site. The Company cannot be, and does not intend nor purport to be, responsible for the privacy practices of other external websites, uses of the information collected by other external websites, or the content of those other external websites.

Children’s Privacy

The Company does not knowingly collect personal information from children under the age of 13 without parental consent, unless permitted by law. If the Company learns that a child under the age of 13 has provided it with personal information, it will delete the information in accordance with applicable law.

Your California Privacy Rights.

California law permits Users who are California residents to request and obtain, once a year, certain information regarding the Company’s disclosure, if any, of certain categories of personal information to third parties for their direct marketing purposes in the preceding calendar year. The Company does not share personal information with third parties for their own direct marketing purposes, except with a User’s consent.

Do-Not-Track

There currently is no industry standard concerning, what, if anything websites should do when they receive browser-based “do-not-track” signals, and it is not always clear whether users intend for these signals to be transmitted or whether they even are aware of them. As such, the Site currently does not respond to such signals.

Consent

By using the Company’s Site, the User voluntarily and knowingly consents to the collection and use of this information by the Company, as disclosed in this Internet Privacy Policy.

Notice of Updates to Policy

The Company may revise this Privacy Policy at any time. It will notify Users of changes by posting changes to the Site or by other appropriate means. A User’s continued use of the Site or provision of personal information the Company following such changes indicates consent to the revised Privacy Policy.
